Protection of the Family

The Issue

Over the past few years, a troubling new trend at the international human rights level is being observed, where discourses on ‘protecting the family’ are being employed to defend violations committed against family members, to bolster and justify impunity, and to restrict equal rights within and to family life.

The campaign to "Protect the Family" is driven by ultra-conservative efforts to impose "traditional" and patriarchal interpretations of the family, and to move rights out of the hands of family members and into the institution of ‘the family’.

“Protection of the Family” efforts stem from:

  • rising traditionalism,
  • rising cultural, social and religious conservatism and
  • sentiment hostile to women’s human rights, sexual rights, child rights and the rights of persons with non-normative gender identities and sexual orientations.

Since 2014, a group of states have been operating as a bloc in human rights spaces under the name “Group of Friends of the Family”, and resolutions on “Protection of the Family” have been successfully passed every year since 2014.

This agenda has spread beyond the Human Rights Council. We have seen regressive language on “the family” being introduced at the Commission on the Status of Women, and attempts made to introduce it in negotiations on the Sustainable Development Goals.

Our Approach

AWID works with partners and allies to jointly resist “Protection of the Family” and other regressive agendas, and to uphold the universality of human rights.

In response to the increased influence of regressive actors in human rights spaces, AWID joined allies to form the Observatory on the Universality of Rights (OURs).  OURs is a collaborative project that monitors, analyzes, and shares information on anti-rights initiatives like  “Protection of the Family”.

Rights at Risk, the first OURs report, charts a map of the actors making up the global anti-rights lobby, identifies their key discourses and strategies, and the effect they are having on our human rights.   

The report outlines “Protection of the Family” as an agenda that has fostered collaboration across a broad range of regressive actors at the UN.  It describes it as: “a strategic framework that houses “multiple patriarchal and anti-rights positions, where the framework, in turn, aims to justify and institutionalize these positions.”

La Organización Sindical de Trabajadoras del Sexo (OTRAS) es el primer sindicato de trabajadoras del sexo de la historia de España. Nació de la necesidad de garantizar los derechos sociales, legales y políticos de las trabajadoras sexuales en un país donde los movimientos de extrema derecha están cada vez más fuertes.

Después de años de luchas contra el sistema legal español y los grupos abolicionistas del trabajo sexual que solicitaron su cierre, OTRAS finalmente obtuvo su estatus legal como sindicato en 2021.

¿Su objetivo? Despenalizar el trabajo sexual y garantizar condiciones y entornos de trabajo dignos para todxs lxs trabajadorxs sexuales.

El sindicato representa a más de 600 trabajadorxs sexualxs, muchxs de lxs cuales son inmigrantes, racializadxs y sexo/genero disidentes.

Zita était une défenseure des droits des femmes de la région du Grand Kivu.

Elle a été la première directrice exécutive d’UWAKI, une organisation de femmes bien connue. Par son travail avec le Réseau des Femmes pour la Défense des Droits et la Paix (RFDP) et le Caucus des femmes du Sud-Kivu pour la paix, elle a consacré sa vie à rétablir la paix dans l'est de la RDC. Elle a très fermement dénoncé l'utilisation de la violence sexuelle comme arme de guerre.

En 2006, elle s'est présentée comme candidate aux premières élections démocratiques en RDC. Bien qu’elle n’ait pas gagné, elle a continué à défendre les droits des femmes et la communauté du Sud-Kivu se souvient d’elle avec affection.

Biography

Claudia est Professeure en Egalité et équité pour le développement, psychologue féministe, activiste en faveur de la défense des droits humains depuis 30 ans et des droits des femmes depuis 24 ans.

Claudia, qui travaille au Salvador, est co-fondatrice et directrice générale de l’association Mujeres Transformando, et défend depuis 16 ans les droits du travail des travailleuses du secteur des maquiladoras textiles et de l’habillement. Elle a collaboré à la formulation d’initiatives législatives, à des propositions de politiques publiques et de recherches visant à améliorer la qualité de l’emploi pour les femmes travaillant dans ce secteur, en plus de travailler sans relâche au renforcement de l’organisation et de l’autonomisation des ouvrières des maquiladoras textiles et des couturières à domicile.

Elle participe activement à des actions de plaidoyer à l’échelle nationale, régionale et internationale pour la défense et la revendication des droits du travail de la classe ouvrière du Sud mondial d’un point de vue féministe, anticapitaliste, anti-patriarcal et dans une perspective de prise de conscience de la classe et du genre. Elle fait partie du Conseil d'administration de l'Initiative Spotlight et du Groupe national de référence de cette dernière. Elle fait également partie du Groupe consultatif de la société civile de l'ONU Femmes.

Bessy Ferrera a défendu sans relâche les droits humains des personnes trans, travailleuses du sexe et séropositives au Honduras. 

 Bessy était aussi membre d’Arcoíris, une organisation qui soutient la communauté LGBTI+. Elle était en outre la personne référente de la plateforme Derechos aquí y Ahora (les droits ici et maintenant) au Honduras et plaidait fermement en faveur d’une pleine citoyenneté pour les personnes trans, ainsi que pour l’adoption d’une loi sur l’identité de genre qui permettrait aux personnes trans de changer légalement d’identité de genre.

Bessy était une travailleuse du sexe qui a été tuée par balle par deux hommes, au début du mois de juillet 2019, alors qu’elle travaillait dans les rues Comayagüela. Ses assaillants ont par la suite été arrêtés.  

Bessy fait partie des nombreux·ses activistes des droits LGBTI+ du Honduras, assassiné·e·s en raison de leur identité et de leur travail, parmi qui se trouvent : Cynthia Nicole, Angy Ferreira, Estefania "Nia" Zuniga, Gloria Carolina Hernandez Vasquez, Paola Barraza, Violeta Rivas et Sherly Montoya.

Le cas de Bessy incarne l’injustice, de même qu’un problème plus large de violence systémique à laquelle se confronte la communauté LGBTI+ au Honduras, puisque l’État ne parvient pas à garantir l’offre de droits ni à fournir une protection. Cela est à l’origine d’une culture de l’impunité.   

Malgré les risques auxquels sont confronté.e.s les activistes LGBTI+ au Honduras,  tous et toutes continuent leur travail pour défier et résister à la violence, ainsi que pour combattre la stigmatisation et la discrimination au quotidien.

She has an LLB from National University of Singapore, enjoys following her feet down random city streets and likes coffee a little too much.

Anti-Rights Tactics, Strategies, and Impacts

Chapter 5

Anti-rights actors adopt a double strategy. As well as launching outright attacks on the multilateral system, anti-rights actors also undermine human rights from within. Anti-rights actors engage with the aim of co-opting processes, entrenching regressive norms, and undermining accountability.

Anti-rights actors’ engagement in international human rights spaces has a principal purpose: to undermine the system and its ability to respect, protect and fulfill human rights for all people, and to hold member states accountable for violations. Some anti-rights tactics operate from outside the UN and include delegitimization and political pressure to defund the UN, or to withdraw from international human rights agreements.  In recent years, anti-rights actors have also gained increasing influence inside the UN. Their inside tactics include training of delegates, distortion of human rights frameworks, watering down human rights agreements, infiltrating NGO committees, applying for ECOSOC status under neutral names, infiltrating youth spaces, and lobbying to place anti-rights actors in key positions.

Navleen Kumar was a fervent land rights and social justice activist in India.

With commitment and integrity, she worked for more than a decade to protect and restore the lands of Indigenous people (adivasi) in Thane district, an area taken away by property and land developers using such means as coercion and intimidation. She fought this injustice and crime through legal interventions at different courts, realizing that manipulation of land records was a recurrent feature in most cases of land acquisition. In one of the cases, that of the Wartha (a tribal family), Navleen found out that the family had been cheated with the complicity of government officials.

Through her work, she helped restore the land back to the Wartha family and continued to pursue other cases of adivasi land transfers.

“Her paper on the impact of land alienation on adivasi women and children traces the history and complexities of tribal alienation from the 1970s, when middle class families began to move to the extended suburbs of Mumbai as the real estate value in the city spiralled.

Housing complexes mushroomed in these suburbs, and the illiterate tribals paid the price for this. Prime land near the railway lines fetched a high price and builders swooped down on this belt like vultures, to grab land from tribals and other local residents by illegal means.”

During the course of her activism, Navleen received numerous threats and survived several attempts on her life. Despite these, she continued working on what was not only important to her but contributed to changing the lives and realities of many she supported in the struggle for social justice. 

Navleen was stabbed to death on 19 June 2002 in her apartment building. Two local gangsters were arrested for her murder.

Eni Lestari

Biography

Eni Lestari es una trabajadora de casa particular (doméstica) que vive en Hong Kong y es activista por los derechos de lxs migrantes. Tras escapar de un empleador abusivo, dejó de ser víctima y se transformó en organizadora de lxs trabajadorxs de casa particular y de lxs migrantes en general. En 2000 fundó la Association of Indonesian Migrant Workers [Asociación de Trabajadoras Migrantes de Indonesia, ATKI-Hong Kong] que luego se expandió a Macao, Taiwan e Indonesia. Fue coordinadora y una de las voceras del Asia Migrants Coordinating Body [Organismo Coordinador de Migrantes de Asia, AMCB], alianza de organizaciones de base en Hong Kong que reúnen a migrantes de Indonesia, Filipinas, Tailandia, Nepal y Sri Lanka. Actualmente preside la Alianza Internacional de Migrantes, primera alianza global de migrantes de base, inmigrantes, refugiadxs y otras personas desplazadas.

Ha ocupado cargos importantes en distintas organizaciones como Asia Pacific Forum on Women, Law and Development [Foro de Asia-Pacífico sobre Mujeres, Derecho y Desarrollo, APWLD] cuyo Consejo Regional integra. También formó parte del Consejo Directivo de la Alianza Contra la Trata de Mujeres (GAATW), fue vocera de la Network of Indonesian Migrant Workers [Red de Trabajadrxs Migrantes de Indonesia, JBMI], consejera de ATKI-Hong Kong y Macao así como de la Association of Returned Migrants and Families in Indonesia [Asociación de Migrantes y Familias Retornadas en Indonesia, KABAR BUMI]. Ha sido ponente en foros organizados por la academia, grupos interreligiosos, sociedad civil, sindicatos y muchas otras entidades en espacios nacionales, regionales e internacionales.

También ha participado activamente en asambleas/conferencias de la ONU sobre desarrollo y derechos de lxs migrantes y fue elegida para hablar en la apertura de la Asamblea General de la ONU sobre Grandes Desplazamientos de Migrantes y Refugiados realizada en 2016 en la ciudad de Nueva York, Estados Unidos. Recibió nominaciones y reconocimientos como ser incluida entre las mujeres que inspiran de la serie 100 Women de la BBC; Heroína pública (RCTI), Mujer influyente en la categoría lideresa del sector sin fines de lucro (Cámara Estadounidense en Hong Kong), Hacedora de cambios (Cathay Pacific) y un premio del Club Indonesio.
