Protection of the Family

The Issue

Over the past few years, a troubling new trend at the international human rights level is being observed, where discourses on ‘protecting the family’ are being employed to defend violations committed against family members, to bolster and justify impunity, and to restrict equal rights within and to family life.

The campaign to "Protect the Family" is driven by ultra-conservative efforts to impose "traditional" and patriarchal interpretations of the family, and to move rights out of the hands of family members and into the institution of ‘the family’.

“Protection of the Family” efforts stem from:

  • rising traditionalism,
  • rising cultural, social and religious conservatism and
  • sentiment hostile to women’s human rights, sexual rights, child rights and the rights of persons with non-normative gender identities and sexual orientations.

Since 2014, a group of states have been operating as a bloc in human rights spaces under the name “Group of Friends of the Family”, and resolutions on “Protection of the Family” have been successfully passed every year since 2014.

This agenda has spread beyond the Human Rights Council. We have seen regressive language on “the family” being introduced at the Commission on the Status of Women, and attempts made to introduce it in negotiations on the Sustainable Development Goals.

Our Approach

AWID works with partners and allies to jointly resist “Protection of the Family” and other regressive agendas, and to uphold the universality of human rights.

In response to the increased influence of regressive actors in human rights spaces, AWID joined allies to form the Observatory on the Universality of Rights (OURs).  OURs is a collaborative project that monitors, analyzes, and shares information on anti-rights initiatives like  “Protection of the Family”.

Rights at Risk, the first OURs report, charts a map of the actors making up the global anti-rights lobby, identifies their key discourses and strategies, and the effect they are having on our human rights.   

The report outlines “Protection of the Family” as an agenda that has fostered collaboration across a broad range of regressive actors at the UN.  It describes it as: “a strategic framework that houses “multiple patriarchal and anti-rights positions, where the framework, in turn, aims to justify and institutionalize these positions.”

Magaly Quintana era conocida por muchxs en Nicaragua como 'La Maga'. Fue una historiadora feminista, activista y defensora inquebrantable de los derechos de las mujeres que exigía justicia para las víctimas de femicidio.

Magaly se comprometió a documentar y elaborar estadísticas sobre las mujeres y niñas que fueron asesinadas como resultado de la violencia sexual en el país.

"Ella reconstruyó la vida de cada una, de sus familias, para mostrar así las vidas que habían sido  destrozadas". - Dora María Téllez

Magaly también criticó al gobierno por la reforma de la Ley 779 que trata la violencia contra las mujeres.  Como resultado del arduo trabajo de los movimientos de mujeres nicaragüenses, esta ley, antes de su reforma, incluía importantes disposiciones para penalizar el femicidio. Magaly argumentó que estas reformas legislativas debilitaban la ley, y limitaban la definición de los femicidios a homicidios, invisibilizando, como resultado, los delitos violentos contra las mujeres.

La organización feminista de Magaly se fundó a principios de los ‘80. Fue la directora de Mujeres Católicas por el Derecho a Decidir, que defiende el derecho al aborto terapéutico tras su prohibición en 2006. En 2018, apoyó las protestas contra el gobierno de Daniel Ortega.

Magaly nació en mayo de 1952 y falleció en mayo de 2019.

AWID está comprometida con la creación de un espacio virtual que nos invite y desafíe a todxs a funcionar desde un lugar de valentía, curiosidad, generosidad y responsabilidad compartida.
 
Te invitamos a crear conjuntamente con nosotrxs espacios libres de acoso y violencia, donde todas las personas sean respetadas en su identidad y expresión de género, raza, capacidad, clase, religión, idioma, etnia, edad, ocupación, tipo de educación, sexualidad, tamaño corporal y apariencia física. Espacios donde reconozcamos las desigualdades que prevalecen en nuestro mundo, y nos esforcemos por transformarlas.

Queremos crear un espacio donde:

  •  podamos estar “presentes”:

Esto significa escucharnos, comprendernos y vincularnos. Sentirnos cerca, a pesar de la virtualidad. Para eso, contaremos con interpretación y abriremos canales (como el chat y otras herramientas) para reaccionar y compartir. Para lograr escucharnos mejor, les invitamos a utilizar audífonos o auriculares durante la sesión. Si puedes hacerlo, te sugerimos cerrar tus correos electrónicos y cualquier otra posible distracción mientras estás en la conversación. 

  • todas las formas de conocimiento son valoradas:

Celebremos los distintos saberes y  las múltiples formas en que estos se expresan. Nos acercamos al espacio con curiosidad y apertura para aprender de otrxs y permitiéndonos desaprender y reaprender a partir del intercambio, sentando las posibilidades para la construcción colectiva de conocimiento. 

  • todxs nos sintamos bienvenidxs:

Estamos comprometidxs con un enfoque holístico de la accesibilidad, conscientes de las diferentes necesidades físicas, mentales, de idioma y de seguridad. Queremos un espacio que acoja a gente de contextos, creencias, capacidades y experiencias diversas. Seremos proactivxs, pero también te pedimos que nos comuniques tus necesidades, para que, dentro de nuestras posibilidades, nos ocupemos de satisfacerlas.

  • todxs nos sintamos segurxs y respetadxs:

Asumimos compromisos individuales y colectivos de respetar la privacidad y contar con el consentimiento de otrxs para difundir imágenes o contenido generado durante la conversación. 

Crear un ambiente más seguro, respetuoso y disfrutable para las conversaciones es responsabilidad de todxs.

Si notas que alguien se está comportando de forma discriminatoria u ofensiva, por favor, contacta a la persona de referencia que se indicará al comienzo de la sesión.

Nana Abuelsoud

Biography

Nana est militante féministe et chercheuse spécialisée dans les droits reproductifs et les politiques démographiques. Elle exerce ses activités en Égypte. Elle collabore avec Realizing Sexual and Reproductive Justice (RESURJ), siège au conseil consultatif de l’A Project au Liban et fait partie du comité communautaire de Mama Cash. Nana est diplômée d’un master en santé publique de l’Institut KIT et de l’Université Vrije d’Amsterdam. Son travail consiste à analyser et contextualiser les politiques démographiques nationales tout en documentant les questions liées à l’eugénisme contemporain, aux programmes d’aide internationale régressifs et aux régimes autoritaires. Auparavant, elle a collaboré avec la Fondation genevoise pour la formation et la recherche médicales, l’Initiative égyptienne pour les droits de la personne, ainsi qu’avec le Collectif féministe Ikhtyar au Caire.

Janet Benshoof était une avocate des droits humains oeuvrant aux États-Unis et défenseure de l’égalité des femmes et de leurs droits sexuels et reproductifs.

Elle a milité pour l’élargissement de l’accès à la contraception et à l’avortement dans le monde entier, et s’est battue contre des décisions anti-avortement dans le territoire américain de Guam. Arrêtée en 1990 pour son opposition à la loi anti-avortement la plus restrictive de son pays, elle a remporté une mise en demeure [MB1] au tribunal local à Guam qui a bloqué la loi, pour ensuite remporter l’affaire devant la Cour d’Appel de Ninth Circuit, décision qui devait supprimer définitivement celle-ci.

Janet a créé plusieurs précédents juridiques, dont l’approbation par l’US Food and Drug Administration de la contraception d’urgence, ainsi que l’application du droit international afin de garantir leurs droits aux victimes de viol lors des poursuites pour crimes de guerre de l’époque de Saddam Hussein, devant la Cour Suprême iraqienne. 

Janet était présidente et fondatrice du Global Justice Center, ainsi que fondatrice du Center for Reproductive Rights, la première organisation internationale pour les droits humains, centrée sur le choix reproductif et l’égalité. Elle a siégé pendant 15 ans en tant que directrice du projet pour les droits reproductifs de l’American Civil Liberties Union, où elle a mené de nombreuses procédures juridiques qui ont contribué à façonner la loi constitutionnelle des États-Unis sur l’égalité de genre, la liberté d’expression et les droits reproductifs.

 « Janet était connue pour son brillant esprit juridique, son sens de l’humour vif et son courage face à l’injustice », Anthony D. Romero.

Nommée l’une des « 100 avocat·e·s les plus influent·e·s d’Amérique » par le National Law Journal, Janet a reçu de nombreux prix et distinctions. 

Née en mai 1947, Janet est décédée en décembre 2017.

Mena Mangal was a prominent TV journalist, women’s rights advocate and cultural adviser to Wolesi Jirga, the lower house of Afghanistan's national parliament. 

For more than a decade, she worked for Ariana TV, Tolo TV's Pashto-language channel Lamar, and the private Afghan national television broadcaster Shamshad TV. As a presenter, Mena focused on women’s rights and cultural talk shows. 

"Women's rights activist Wazhma Frogh said Mangal "had a loud voice" and actively spoke out as an advocate for her people."

Off-screen, she also ran popular social media pages that advocated for the rights of Afghan girls and women to education and work. In terms of her private life, Mena wrote extensively about being forced into an arranged marriage in 2017 and the process she had to go through to finally obtain a divorce. 

In a Facebook post, Mena wrote she was receiving death threats from unknown sources but would continue to carry out her work.

On 11 May 2019, she was attacked by unknown gunmen and shot dead in broad daylight in a public space in Southeast Kabul. 

"We are concerned about the situation because it has a direct impact on women who work outside their homes...Female journalists are changing their professions due to the increasing risks they are facing." - Robina Hamdard, Kabul-based women’s rights activist.

Anti-Rights Tactics, Strategies, and Impacts

Chapter 5

Anti-rights actors adopt a double strategy. As well as launching outright attacks on the multilateral system, anti-rights actors also undermine human rights from within. Anti-rights actors engage with the aim of co-opting processes, entrenching regressive norms, and undermining accountability.

Anti-rights actors’ engagement in international human rights spaces has a principal purpose: to undermine the system and its ability to respect, protect and fulfill human rights for all people, and to hold member states accountable for violations. Some anti-rights tactics operate from outside the UN and include delegitimization and political pressure to defund the UN, or to withdraw from international human rights agreements.  In recent years, anti-rights actors have also gained increasing influence inside the UN. Their inside tactics include training of delegates, distortion of human rights frameworks, watering down human rights agreements, infiltrating NGO committees, applying for ECOSOC status under neutral names, infiltrating youth spaces, and lobbying to place anti-rights actors in key positions.

Investissement à impact de genre et émergence de fausses solutions :

une analyse pour les mouvements féministes

L'investissement à impact de genre est désormais considéré comme une solution contre les inégalités de genre. Et pourtant, comme le montre notre rapport, il fait partie du problème. Les institutions publiques et privées en font la promotion en tant que moyen pour parvenir à l'égalité de genre et pour accroître les ressources des femmes et des filles.

Mais en aucun cas, ces affirmations ne sont étayées par des preuves.

Au contraire, l’investissement à impact de genre constitue plutôt une nouvelle version de vies et de sociétés soumises à une même logique financière, qui continue de façonner les profondes inégalités de notre monde.

Avec ce rapport, l'AWID offre aux lecteurs·rices - féministes, défenseur·euse·s de la justice de genre et autres parties prenantes de l'investissement à impact de genre - une analyse critique et des preuves étayées pour comprendre l’investissement à impact de genre, ses récits et les implications économiques et politiques qu’il a pour les mouvements féministes.
